EMEAA LOYALTY WEEK CHALLENGE PROMOTION

THIS IHG ONE REWARDS EMEAA LOYALTY WEEK CHALLENGE PROMOTION IS OFFERED IN CONNECTION WITH THE 2023 IHG® EMEAA LOYALTY WEEK AND IS INTENDED ONLY FOR ELIGIBLE PARTICIPANTS AND WILL BE GOVERNED BY THE LAWS OF ENGLAND AND WALES. DO NOT PARTICIPATE IF YOU ARE NOT ELIGIBLE. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE OR WIN. VOID WHERE PROHIBITED.

  1. Eligibility: The IHG One Rewards EMEAA Loyalty Week Challenge Promotion (the “EMEAA Loyalty Week Challenge” or “Promotion”) is open to only those individuals who meet all of the following: (a) They are at least eighteen (18) years of age or the minimum age of majority in their jurisdiction of residence (whichever is older); and (b) they are a hotel general manager, representative, or employee working at an IHG branded hotel in Europe, IMEA, SEAK and JAPAC (EMEAA). Corporate level employees of Sponsor or its affiliates directly involved in the development or administration of this Promotion and employees of Administrator or its affiliates are not eligible to participate in this EMEAA Loyalty Week Challenge Promotion. (“Sponsor” and “Administrator” are defined in Section 2 below.) Participation is invalid where prohibited by law or if prohibited under the rules or policies of the company the individual is employed by or representing. For the purposes of this Promotion “IHG Branded Hotels” means any hotel that Sponsor or its affiliates owns, operates, manages or franchises under an IHG brand in EMEAA, existing presently or in the future, including but not limited to InterContinental® Hotels & Resorts, Crowne Plaza® Hotels & Resorts, Holiday Inn®, Holiday Inn Express®, Staybridge Suites®, Regent® Hotels & Resorts, Hotel Indigo®, vocoTM hotels, Kimpton® Hotels & Restaurants, Six Senses® Hotels, Resorts, & Spas and VignetteTM Collection.
  2. Sponsorship and Administration of the EMEAA Loyalty Week Challenge Promotion: The “Sponsor” of the EMEAA Loyalty Week Challenge Promotion is Six Continents Hotels, Inc., 3 Ravinia Drive, Suite 100, Atlanta, GA 30346. The EMEAA Loyalty Week Challenge Promotion is being administered by Sponsor in association with Coffee Digital LLC., 177 Mott Street, New York, NY 10012 (“Administrator”).
  3. Reservation of Rights: For purposes of these Official Rules, any and all rights granted or reserved for the benefit of Sponsor or Administrator are to be construed to be to the fullest extent permitted under the applicable law for the particular circumstances where such rights are implicated.
  4. Agreement to Official Rules: By participating or attempting to participate in the EMEAA Loyalty Week Challenge Promotion, a person (whether eligible to participate or not) is fully and unconditionally agreeing to accepting these terms and conditions (the “Official Rules”) and the decisions of the Sponsor, which are final and binding in all matters related to the EMEAA Loyalty Week Challenge and interpretation of these Official Rules. Whether a participant receives a prize is contingent upon fulfilling all applicable requirements set forth in these Official Rules.
  5. Promotion Period: The “Promotion Period” begins on 15 October 2023 at 19:00 British Summer Time (“BST”) and ends at 23:59 BST on 22 October 2023. There will be a total of four hundred (400) hotel winners selected in the Weekly Challenge and one hundred and fifty (150) hotel winners selected after the Weekly Challenge as set out below. The drawings and selection for the Prizes are scheduled to take place from 23 October 2023 to 28 November 2023. Participants will have the opportunity to complete challenges during the Promotion Period for a chance to win IHG One Rewards Points. Additional details about participating in the EMEAA Loyalty Week Challenge Promotion, the requirements and procedure for entries, and how the prizes are awarded are provided in other sections of these Official Rules, including but not limited to Sections 6 and 7 below.
  6. Prizes: For the EMEAA Loyalty Week Challenge Promotion, there will be a total of four hundred (400) prize winners for the IHG One Rewards points prize consisting of fifty thousand (50,000) IHG One Rewards points each. Each Points Prize will be awarded per hotel in a form of digital voucher codes sent to Hotel General Managers for distribution among individual hotel colleagues or to be used as a team prize. IHG One Rewards points do not have a cash value. Should a prize become unavailable for any reason, Sponsor reserves the right to substitute a prize of equal or greater approximated value.
  7. Participation in the EMEAA Loyalty Week Challenge Promotion; Identifying Prize Winners: For each activity of EMEAA Loyalty Week, hotel colleagues will be able to take part via a dedicated website (“Loyalty Week Activity Hub”, “Activity Hub”) hosted by the Administrator. Hotel colleagues must complete each activity by submitting evidence through the Activity Hub as per the guidance provided in the Loyalty Week Implementation Guide and earn Badges. There are four (4) activities to complete: 1. Launch Day Activity, 2. Trivia Challenge Activity, 3. Member Recognition Activity, 4. Member Guest Love Activity. Hotel teams that register on the Activity Hub and submit evidence for all four (4) activities, earning a Diamond Badge, will be entered into a prize draw for a chance to win one of four hundred (400) prizes of fifty thousand (50,000) IHG One Rewards points. A hotel may only win once and only win a maximum of one (1) prize. If the number of entries does not reach the number stated here, all entries will be awarded prizes.
  8. By submitting evidence for activities during the Entry Period, an eligible Hotel has agreed to participate in the Promotion. All evidence must be submitted in the Activity Hub by 23:59 BST on 22 October 2023. Hotels must ensure that submissions do not include guest personal details, their name, IHG One Rewards membership number, company name, contact details or any other information allowing to identify guests.

    Activity 1 will require submission of photos. Photos may be submitted as part of Activity 3. Photos must be in .jpeg format. All photos submitted must meet each of the following requirements:

    • Each submission must comply with these Official Rules.
    • The photo cannot be sexually explicit or suggestive or contain nudity.
    • The photo cannot contain or support violence.
    • The photo cannot be derogatory of any ethnic, racial, gender, gender identity, religious, sexual orientation, professional or age group.
    • The photo cannot include profanity or other inappropriate language.
    • The photo cannot reference or promote alcohol, drugs, tobacco, firearms/weapons, or any activities that may appear unsafe or dangerous.
    • The photo cannot promote any particular political agenda or message.
    • The photo cannot include images or words that are obscene or offensive or that endorse any form of hate or hate group.
    • The photo cannot include misstatements, or contain disparaging remarks or messaging, about Sponsor or its products or services, or about other people, companies, products, or services.
    • Each submission cannot contain trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind, other than IHG or an IHG brand.
    • The photo cannot include any images or words that could be used for personal identification, such as license plate numbers, personal names, phone numbers, e-mail addresses or street addresses.
    • A submission cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media).
    • No background artwork, murals, prints, sculptures, or other works of art or copyrighted materials should appear in any photo or video, unless it is an original work of the participant making the submission.
    • The photo cannot contain materials that include the names, likenesses, images, or other content identifying any person, living or dead, without the permission of the person.
    • The photo cannot include words, or portray acts, that violate any laws or that encourage or support others to violate any laws.

    Any photo that does not meet all of the standards listed above may be rejected and not qualify for an entry into any of the prize drawings. In addition, if a participant plans to submit a photo that includes others, the participant must have each person’s permission to include them in the photo, and any participant who submits a photo that includes other individuals is representing that they have obtained the consent of each person. The failure to obtain consent may disqualify the participant from the Promotion.

  9. Bonus Prizes

    There will be two additional opportunities to win a bonus prize. The first bonus prize is the Outstanding Submissions prize. In this category, up to one hundred (100) hotel teams will receive one hundred thousand (100,000) IHG One Rewards Points per hotel. These winners will be selected by the Sponsor (a panel comprising members of the IHG corporate team). The Sponsor shall review the evidence submitted for Activity 3: Member Recognition and Activity 4: Member Guest Love, via the Activity Hub, by all hotels that completed all four (4) activities and earned a Diamond Badge. The Sponsor will then select which of these submissions exhibit best practice based on the specific criteria to (i) enhance performance in the Member Recognition metric and Overall Experience (Guest Love) metric for IHG One Rewards members that (ii) can then be recommended to all EMEAA hotels. Submissions that contravene the loyalty programme's Terms and Conditions or deviate from IHG's guidance on the loyalty programme delivery, will not be considered. A hotel may only win once and only win a maximum of one (1) prize. If the number of outstanding submissions does not reach the number stated here, IHG reserves the right to award less prizes. The second bonus prize is the Surprise and Delight prize. In this category, two hundred thousand (200,000) IHG One Rewards points will be awarded to fifty (50) hotel teams that completed all four (4) activities and earned a Diamond Badge, are both compliant with all Loyalty Brand Standard components in Q3 2023 and the top performers in Enrolment Efficiency and Member Recognition Hotel Metrics in September 2023 YTD. In the event of a tie for a prize, each of the participants with the same score will be considered a winner of the prize. A hotel may only win once and only win a maximum of one (1) prize. If the number of entries does not reach the number stated here, IHG reserves the right to award less prizes. Participation in this EMEAA Loyalty Week Challenge Promotion and receipt of any prizes by an individual is subject to the internal policies of the company, organization or entity they are employed by or represent, and by participating, each such individual agrees that their participation is permitted by, and is in conformity with, those internal policies. An individual’s participation may be deemed invalid if prohibited by any such policy. All potential winners are subject to verification of eligibility before any prize is awarded to them.
  10. Agreement to Share Information: By submitting personal information in connection with this EMEAA Loyalty Week Challenge Promotion, a participant is giving consent to share the information with Sponsor, Administrator, and their respective affiliated companies for purposes of administering the EMEAA Loyalty Week Challenge Promotion, and the participant is also giving Sponsor specific permission to use their name and any email addresses they have provided for communications relating to the EMEAA Loyalty Week Challenge Promotion or to any prizes that may be awarded as part of the EMEAA Loyalty Week Challenge Promotion.   11. Claiming Prizes: Prize winners will be notified by email. A prize winner will have two (2) options to consider after being notified: (a) claim the prize; or (b) choose not to claim the prize. A prize winner is not to claim a prize if participating in the EMEAA Loyalty Week Challenge Promotion or receiving the prize is prohibited under the laws where they reside or by the rules or policies of the company or hotel they work for or represent. Prize winners are responsible for determining if they are prohibited from claiming a prize. If a prize is to be claimed, it can only be claimed by the Prize Winner selected for that prize and cannot be transferred or assigned or redeemed for cash. If a prize winner chooses not to claim a prize, Sponsor may, but is obligated to, select an alternate winner (generally following the same procedure as described in these Official Rules for determining the winner of the type of prize).

    IHG One Rewards points claimed as a prize by a prize winner will be awarded per hotel in a form of digital voucher codes sent to Hotel General Managers for distribution among individual hotel colleagues or to be used as a team prize. IHG One Rewards points awarded and claimed as a prize will not count toward Elite status qualification or any other promotional benefit that Sponsor offers. Any points awarded to a prize winner are subject to the terms and conditions of the IHG One Rewards programme, which are subject to change at any time without notice, and may be found at: https://www.ihg.com/content/us/en/customercare/member-tc. The value of any awarded prize may be taxable to the prize winner as income under the laws of the jurisdiction where the prize winner resides or works. The payment of any applicable national, federal, state, provincial, and local taxes associated with a prize awarded and accepted by a participant, and any other costs and expenses associated with the acceptance and/or use of prize not specifically provided for in these Official Rules, are the responsibility of the prize winner. Prize winner must contact their own tax advisor for any questions concerning any taxes that may apply.

  12. Winner Notification: The prize winners will be announced in Hotel Experience Champion Calls on or around 29 - 30 November 2023. ALL POTENTIAL PRIZE WINNERS AND ANY RELATED SUBMISSIONS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DETERMINATIONS ARE FINAL AND BINDING. ANY EMEAA LOYALTY WEEK CHALLENGES THAT ARE NOT COMPLETED UNTIL AFTER THE LAST DAY OF THE CHALLENGE ARE VOID AND WILL NOT QUALIFY AS A VALID ENTRY FOR ANY PRIZE AWARDS OR DRAWINGS. Sponsor is not responsible for the inaccuracy of, or any change to, a participant’s email address. In the event of any dispute as to whether a EMEAA Loyalty Week Challenge was completed or qualifies, Sponsor’s determination is final and binding.
  13. Winner Requirements: If a prize winner cannot be contacted, fails to provide any requested information within the required time period, or chooses not to claim the prize, that prize winner forfeits the prize. If a prize winner forfeits a prize or is disqualified for any reason, Sponsor may, but is obligated to, pursue the selection of an alternate winner (generally following the same procedure as described in these Official Rules for determining a winner for the type of prize). A prize winner’s claiming of a prize will signify the prize winner’s agreement and consent that Sponsor and its designees may use the prize winner’s hotel name, city, state/province, photo, submission (if applicable), and/or prize information in connection with the EMEAA Loyalty Week Challenge Promotion for promotional, advertising or other purposes, worldwide, in any and all print, broadcast, digital, and online media now known or hereafter devised, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law. Without limiting the generality of these Official Rules, each prize winner hereby irrevocably grants, transfers, and assigns to Sponsor all copyright, trademark rights, and other intellectual property rights in and to prize winner’s submission(s) in connection with the EMEAA Loyalty Week Challenge Promotion (if applicable), on a worldwide basis in perpetuity for any and all purposes. Sponsor will not incur any liability whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder. Each prize winner agrees to indemnify Sponsor, Released Parties (defined below in Section 13) and any licensee of Sponsor against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of these Official Rules by the prize winner.
  14. Release: By claiming or accepting any prize, each such prize winner agrees to release and hold harmless Sponsor, and its parent, subsidiary, and affiliated companies, and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including but not limited to personal injury, death, or damage to or loss of property, arising out of participation in the EMEAA Loyalty Week Challenge Promotion or receipt or use or misuse of any prize. This release is not intended to limit or replace any other release or consent that a participant may have given in connection with the EMEAA Loyalty Week Challenge Promotion or the acceptance of any prize awarded as part of the EMEAA Loyalty Week Challenge Promotion.
  15. Limitations of Liability: The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by a participant, printing errors or by any of the equipment or programming associated with or utilized in connection with the EMEAA Loyalty Challenge Promotion; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in network hardware or software; (c) unauthorized human intervention in any part of the EMEAA Loyalty Week Challenge Promotion or data entry process for or relating to the EMEAA Loyalty Week Challenge Promotion; (d) printing, typographical, technical, computer, network or human error which may occur in the administration of the - EMEAA Loyalty Week Challenge Promotion, the uploading, the processing or judging of submissions (if applicable) or votes or the tabulating of votes for such submissions, the uploading, processing, functionality, or data entry in connection with any submissions, or in connection with any announcements, publications or notifications relating to any prizes or in any Promotion-related communications or materials; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from a participant’s participation or attempt to participate in the EMEAA Loyalty Week Challenge Promotion or receipt, use, or misuse of any prize. Released Parties are not responsible for any unauthorized third-party use of any submission (if applicable). No more than the stated number of prizes will be awarded.
  16. Modification; Disqualification; Waiver: Sponsor reserves the right to cancel, suspend and/or modify the EMEAA Loyalty Week Challenge Promotion, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the EMEAA Loyalty Week Challenge Promotion, as determined by Sponsor. Sponsor reserves the right to disqualify any individual it finds to have engaged in any action that compromises the integrity, functioning, or operation of the EMEAA Loyalty Week Challenge Promotion, the prize drawings, or these Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the EMEAA Loyalty Week Challenge Promotion may be a violation of criminal and/or civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.
  17. Dispute Resolution; Governing Law: Except where prohibited by applicable law, each participant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this EMEAA Loyalty Week Challenge Promotion or any prize awarded will be resolved (i) individually, without resort to any form of class action, and (ii) exclusively by the courts of England and Wales; (b) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering this EMEAA Loyalty Week Challenge Promotion, but in no event attorneys’ fees; and (c) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, any indirect, incidental, special, consequential, liquidated, punitive, exemplary, treble, multiplied, or other damages other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participants and Sponsor in connection with the EMEAA Loyalty Week Challenge Promotion, are to be governed by, and construed in accordance with, the laws of the England and Wales without giving effect to any choice of law or conflict of law rules.
  18. Severability: If for any reason the application of any provision of these Official Rules to any particular facts or circumstances is held to be invalid, illegal or unenforceable by a court, arbitration panel or other tribunal of competent jurisdiction, then (a) the validity, legality and enforceability of such provision as applied to any other particular facts or circumstances, and the other provisions of these Official Rules, will not in any way be affected or impaired thereby; and (b) such provision will be enforced to the maximum extent possible.
